The case arose after the petitioner, a probationary correction officer, was terminated by the Nassau County Sheriff’s Department on February 2, 2022. In response, the petitioner commenced a proceeding under CPLR Article 78, challenging the termination.
The petitioner alleged that his dismissal was made in bad faith. Specifically, he claimed that the termination followed complaints he made regarding excessive overtime assignments and the Sheriff’s Department’s failure to comply with internal rules requiring the equal distribution of overtime.
In August 2022, the Nassau County Supreme Court agreed with the petitioner’s position and granted the petition, effectively annulling the termination. The County of Nassau appealed that decision.
Appellate Court Findings
On appeal, the Appellate Division, Second Department, affirmed the lower court’s ruling in full.
The court reiterated the general rule that probationary employees may be terminated without a hearing or stated reason. However, it emphasized a critical exception: such terminations cannot be made in bad faith, for illegal reasons, or in violation of statutory or decisional law.
In this case, the appellate court found that the petitioner met his burden of demonstrating bad faith. The evidence showed that:
- The termination closely followed the petitioner’s complaints about excessive overtime.
- The complaints involved alleged violations of internal rules requiring fair distribution of overtime assignments.
- The timing and circumstances supported an inference that the termination was retaliatory in nature.
Importantly, the court noted that the appellants failed to adequately rebut this showing. They neither established nor sufficiently alleged that the termination was made in good faith.
As a result, the appellate court held that the Supreme Court properly granted the petition and annulled the determination to terminate the petitioner’s employment.
Significance of the Decision
This decision highlights an important limitation on an employer’s discretion when dealing with probationary employees. While such employees typically have fewer protections, courts will intervene where there is evidence of bad faith or retaliatory conduct.
